You Can Be Jailed at the Discretion of an Officer

RECEIVED Thu., July 24, 2008

Dear Editor,
Re: “APD” [News, July 25]: As the result of the (wrong) precedent of Atwater v. Lago Vista (2001) (www.wikipedia.org/wiki/Atwater_v._Lago_Vista), you can be arrested and jailed at the discretion of the officer, even if the offense is nonjailable. The old cop sayings is: "You might beat the rap, but you won't beat the ride."
You might write your legislators asking them to remove arrest authority for officers for nonjailable offenses, because it is being used to abuse people.
