Attack of the Robocaller!

WilCo Dem county attorney challenger claims attack piece breaks federal law

Further mudslinging and allegations of dirty tactics are making the rounds (no shock there in the final days before the election).

Williamson County voters have been recieving a robocall from Tony Dale, the traditional concerned businessman of such pieces. In it, Dale claims that Jaime McCain Lynn, the Democrat running for Wilco county attorney against Republican incumbent Jana Duty, (and not, as Google assumes, Britney Spear's sister, Jamie Lynn) is a two-time criminal.

The first problem is that Lynn says the claim is just not true. The scond issue for the Duty campaign is that the call omits to mention that Dale is actually organizational director of the Williamson County Republican Party. Then there's the lack of any disclaimer saying who paid for it (big possible campaign finance law no-no). Plus, in their press release response, the Lynn campaign says the calls ignore federal do-not-call laws which might get the Federal Communications Commission involved. Lynn has now challenged Duty to explain the allegation at the Round Rock Chamber of Commerce power lunch on Tuesday. He has already accused Duty's campaign of using county facilities for election purposes, so it's pretty easy to imagine that this could be an awkward luncheon. Here's the Lynn presser:

Here is what we know. This morning a robo-call or auto-dialer call campaign was initiated by either the Jana Duty campaign or the Williamson County Republican Party. The voice on the call identified himself as Tony Dale and described himself as a businessman. Mr. Dale is listed as the Organizational Director of the Williamson County Republican Party on their website. The message of the call charges Jaime Lynn with "criminal activity in the State of Texas."

This call is not only spreading a lie, as Jaime Lynn has in no way committed any criminal activity in his campaign or otherwise, but the call itself actually violates Federal Law. The Federal Communications Commission takes violations of the DO-NOT-CALL laws very seriously. Specifically requiring "auto-dialers" to not only name who or what organization is paying for the call but also to provide a phone number for contact to opt-out. Unless Mr. Dale, himself paid for these calls, both laws have been broken.

The mention of the DPS letter also provides confirmation that Mrs. Duty, Ms. Vickers and/or Mr. Ackley have individually or collectively used their position of authority within the county government for personal political gain. Mrs. Duty's use of her elected position and her access to county employees, equipment, phones and titles is a clear dereliction of duty, breach of ethics, and a failure of her oath to the citizens of Williamson County and her oath of integrity as a legal professional.

In the last week Mrs. Duty has twice accused Jaime Lynn of breaking the law. Both charges are unsubstantiated and represent her clear lack of judicial understanding. The law once again rejected her baseless claims and now, has opened Mrs. Duty to federal inquiry and complaint. "She should know better," said Jaime who continued to say that "with her record of weak and failed litigation, I suppose this shouldn't be a surprise."

Jaime Lynn will be speaking at the Round Rock Chamber of Commerce "Power Lunch and Candidates Forum" tomorrow at 11:30 a.m. The lunch is scheduled to be held at the Baca Center in Round Rock. "I'm ready to discuss the issues and her fact-less charges," Jaime said, "She's got a lot of questions to answer, specifically with regards to the laws that she's broken today."
