Third time was not the charm for Tarrant County’s Republican Sen. Kim Brimer in his attempts to get Democrat Wendy Davis off the ballot after a court rejected his latest suit on Oct. 6. Senate District 10 is seen as a close race, and Brimer and his supporters have argued that former Fort Worth Council Member Davis is ineligible to run because her old seat had not been filled when she filed to run against him. Separate suits against Davis had already unsuccessfully been brought by Brimer in July and three Fort Worth firefighters last December. In this latest case, the 5th Court of Appeals ruled his case moot since the deadline had passed to add names to the ballot, so it was too late to remove a candidate. The Brimer campaign has announced it will consider its options, but Democratic Party of Texas Chair Boyd Richie told the incumbent, “It’s time to quit running to the courthouse and show the voters enough respect to let them choose their own senator.”
