At a hastily assembled press conference late this afternoon, City Manager Marc Ott announced City Attorney David Smith‘s decision to retire. The decision came in the wake of the Keypoint report controversy, and Smith’s untenable advice the unflattering report be kept secret.

Ott also made it clear that he had spoken to Smith several times about his dissatisfaction with Smith’s performance and advice in the Keypoint matter.

In a memo announcing his retirement, Smith wrote “I have been lucky to share in the many accomplishments of the Law Department, but take full responsibility for any mistakes we have made.”
