Texas Supreme Court Considers Same-Sex Divorce
Should Austin couple married out of state be granted divorce here?
DAILY News  November 5, 2013, by Jordan Smith
"...Because courts have to recognize the existence of a marriage in order to grant a divorce, the simple act of seeking divorce in and of itself triggers the AG's "inherent" right to defend the law – in these cases, by opposing the dissolution of an out-of-state marriage, Assistant Solicitor General James Blacklock argued before a packed court room Tuesday morning. "All same sex marriages are void and unenforceable" in Texas, Blacklock argued, which means they can't be subject to a divorce proceeding, without presenting a challenge to Texas DOMA, because "divorce unquestionably recognizes" marriage...."

News Story  June 6, 2003
"...Talton tried to ban the placement of foster children in gay or lesbian households (HB 1911 and 194), but a well-organized counterattack -- some 300 people registered their opposition at a hearing on HB 1911 -- effectively deep-sixed the bill. The DOMA measure (SB 7) does not threaten to change the status quo dramatically, since the state never recognized gay unions in the first place -- it's just one more insult piled on injury..."

News Story  April 11, 2003, by Amy Smith
"...Jeff Wentworth (SB 7), each of whom has filed legislation that would variously prevent gays and lesbians from marrying, adopting children, or serving as foster parents. Talton has taken matters further still with HB 1911, which would ban the placement of foster children "with any unmarried individuals." Talton told The Pasadena Citizen: "I don't think it's right to teach a gay and lesbian lifestyle to a young child before the age of accountability." Wentworth also went the extra mile with his Defense of Marriage Act bill, or DOMA, by rounding up 21 co-signers -- it rolled through the Senate State Affairs Committee last week, as Wentworth declared, "People talk about 'discrimination' as though it's a bad thing -- it's something we do all the time." To soften the blow, Wentworth did add a provision saying the bill would not bar contractual relationships or interfere with employee domestic-partner benefits..."
