I'm not sure the Austin Police Department's request for electricity usage stats actually constitutes a Fourth Amendment violation [“
APD Pot-Hunters Are Data-Mining at AE,” News, Nov. 16]. Given that the information obtained by APD is obtainable by virtually anyone who asks for it for long enough, one can't reasonably expect that this defense has any legs to get to the Supreme Court. Sorry, Jordan Smith, your story isn't blowing many whistles, either, but I'm sure Mr. Mark Coffey enjoys the doubtless volumes of calls and e-mails from pissed-off pot advocates who probably don't sound too concerned with peace, love, or understanding. It seems the only way to truly avoid these embarrassing incidents in the future would be to legalize it, no?
