Richard Allan Lee, charged with second-degree felony intoxication manslaughter in the July death of Austin cyclist Vilhelm Hesness, was arrested after several unsuccessful attempts outside his Austin home Tuesday by the Texas Department of Public Safety. Lee hit Hesness from behind as he was riding lawfully along Manchaca Road in far South Austin. Lee was later found to be under the influence of four potent and incompatible prescription drugs, including sedatives Xanax and Soma, as well as Zoloft, an anti-depressant, and meprobamate, a tranquilizer.

The case has renewed calls from the cycling community for stronger enforcement against motorists who endanger, injure, or kill bicyclists as more and more Austinites transport themselves by bike. Fred Meredith, a riding partner of Hesness, editor of Southwest Cycling News, and a longtime member of the Austin Cycling Association, said he had no criticisms of authorities’ pursuit of the case, though others faulted DPS delays in processing Lee’s blood test. "We accept a certain amount of mayhem out there and we realize that cyclists are more vulnerable than other vehicle drivers, but if somebody makes a mistake in their driving behavior that violates the law, they should be prosecuted," Meredith said. "We expect the same level of prosecution given to a motor vehicle or pedestrian case." Lee’s bond was set at $10,000.

The rumors that Mr.Lee had fled and several unsucessful attemps to arrest him are false.The authorities were given his correct address and phone number In July .The time of the fatal accident.Mr.Lee has been employed since the accident and does submit a social security card for employment.So just how hard is it for Austin Police to locate a man at his job or a his home?Because that is where Mr.Lee has been the entire time.And that is where they found him when they were ready for him.

The DPS issued an arrest warrant for Lee Sept. 25 and according to spokeswoman Lisa Block had attempted to locate Lee at his home several times since then unsuccessfully. The DPS also said it had been unable to contact Lee at any of the phone numbers listed for him. I'm not sure where you're getting your information. Are you a friend or relative of Mr. Lee? (By the way, this was the DPS's jurisdiction as opposed to that of the APD, since the crime tool place outside the city of Austin). I tried to contact Lee unsuccessfully as well.

Lee may not have fled, but he definitely didn't turn himself in after a month and a half at large.

It sounds like to me that the newspapers and the cyclist have already decided that Mr. Lee is guilty without even having a trial.I am the aunt of Mr.Lee`s wife and I know for a fact that he hadn`t tried to evade or flee the police.And furthermore,who`s to say in the newspapers that he was over medicated.If his doctor had him on these drugs and he wasn`t abusing them and blood test would tell that,then how can people assume he`s guilty as it appears in the papers and news broadcast??I am truely sorry for Mr.Hesness untimely death under these horrible conditions and for his family,but heaven forbit anyone taking a medication and under a doctors care to have an accident and be tried in the newspaper instead of a courtroom.Let everything come out in the proper place and quit adding to the rumor mill.A concerned relative...

The Lee's cannot cope with the press at this time.Mistakes were made in taking Mr.Lee's address and phone number.Mr.Lee had recently relocated to Austin and had not updated his license..Mrs.Lee provided the correct information,but later seen on a paper that they had written the phone number down wrong.so she called and gave the correct phone number over the phone.She also gave her phone number.She has never recieved a call or been left any messages neither has Mr.Lee. Mrs.Lee keeps names.So she knows who she spoke with.Mr.Lee was not aware of the Sept 25th arrest warrant until about October 2nd when friends told they seen the news broadcast.Mrs.lee leaned about it at work.Mr. Lee did seek legal advice and the authrities were notified that Mr. Lee would co-operate and turn himself in when they were ready to process him.The authorities did know where to locate him and they came right to his door.We are deeply sadden by the death of Mr.Hesness.Of coarse we are concerned for our loved one and the outcome of this trial and if we were Mr.Hesness family or any other family, we would want justice also.Let the courts decide this case. I have no further comment.

This happens. I hardly ever see cyclists riding legally. Usually they are running stop signs and red lights, weaving in and out of traffic/lanes. We've run into many that have been total asses. One even followed us on his bike and kept putting his hands on the one vehicle we haven't gotten rid of, our van. I seriously considered jumping out and kicking his ass.

It is sad when someone dies but there is more at hand than just those evil motorists. I think aggressive cyclists should be targeted as well. In the meantime I'll continue to drive my golf car everywhere I go due to all the insane people driving cars/trucks on the road.

My heart goes out to this cyclists friends and family.

Could it be that law enforcement went to the Lee home,so as to have a record of attempt to arrest,but never atually went to the door,In order to appease the public outcry for an arrest? I persume that law inforcement does according to their work load.They certainly have been known to cover their ass.My sincere condolences to the victims family

Iam familiar with the "database".An arrest warrant can be signed off on by a judge.An arrest will be made once it is entered in the Database.I've been there ,done that. Check it out.

The public needs to educate themselves.Just because an arrest warrant has been issued,doesn't mean an arrest will be made right away.This is something most people

aren't aware of,and it can be frustrating for victims.I know this because my nephew is a cop.

Iam not a friend of the Lee's,Iam a neighbor.I once spoke with the Lee's when they first came to the neighborhood.They were a Cordial couple,but private as most people are.When I first realised thatMr. Lee was the Lee involved in the fatal accident when I no longer seen the Darango in their driveway.Iam puzzled as to why the law was unable to apprehend Mr.Lee at his home on previous occasions.Had they came early in the morning ,the couple would have been home,as Mrs. Lee and I leave our homes about the same time for work.Also,I drive by their house every evening and their vehicals are always there and lights are on in the home.I question the efforts of law to arrest him.I don't know why Mr.lee did not just turn himself in,from what I have read it sounds like he was waiting to be notified. Iam sorry for the Lee's and my condolences go out to the family of the cyclist.


Beware Rogue Cyclists [ Defensive Driver ] Mar 14, 2008 - 12:58 pm
Today as I drove on Bee Cave Rd, approaching the Loop 360 light, a cyclist decided to swerve into the lane my Tahoe occupied. As I would do if he'd been in a car, I honked to get his attention that was obviously elsewhere. As I stopped at the light, this self-righteous ass decided to approach my car, so I rolled down my window. Mr. Cyclist yelled at me to "never honk at cyclists as it's dangerous!" and informed me that he was doing me a favor by riding in the shoulder vs. the lane. As he continued to yell at me, he gave me the finger, then he rode off (weaving in/out of surrounding cars). Incredulously, he and his 2 companions then RODE THROUGH THE RED LIGHT. Since when did cyclists become a protected class on Austin roads? IF YOU COME INTO MY LANE and are not in front of or behind me but rather beside me, YOU ARE IN THE WRONG and YOU are DANGEROUS. If you run a red light, YOU ARE IN THE WRONG and DANGEROUS. Cyclists, if you want to share the roads, follow the same rules. Most car drivers dread seeing you on the road simply because we know you are unpredictable and unwilling to abide by street laws, and we'd be forever horrified if we hit you. Even if it was YOUR FAULT. How about "BE KIND TO DRIVERS"?????
